On May 17, 2024. An officer from the Thorp Police Department was dispatched to a Kwik Trip for the report of a male subject who was passed out in the men's bathroom. An officer went into the bathroom with a staff member who was able to unlock the locked stall door and a male subject, later identified as Tony, was lying on the floor on his right side with only boxers on. Tony was breathing but not responding when the officer attempted to wake him up. He eventually woke up, but his words were incoherent. Tony was able to stand up and get dressed, he was asked to walk into a back room of the store for privacy. He admitted to drinking and said that he was only 20. He was aware he should not be drinking alcohol underage. Tony said that he parked at Kwik Trip, walked to a bar to have a few drinks before walking back, claiming that he was not driving at all after drinking. Tony said he last drank alcohol two hours ago and said that he was drinking Jameson and Sprite. He had two or three. Tony said it was a long day and did not drink enough water. One of the officers went to speak with the store employees who said a customer found Tony laying down in the bathroom and no one saw him walk into the store. None of the employees working knew how to operate the camera system. While searching Tony, officers seized a can of nicotine pouches because he was underage. A PBT test showed he has a BAC of .130. The next day, officers went to Kwik Trip to review the camera footage. The footage showed that Tony did not leave the parking lot and walk anywhere. He drove into the lot, parked and went straight to the mens restroom. Tony was found to be lying and he did drive from the bar with alcohol in his system. Tony was found guilty for Resisting or Obstructing an Officer, Underage Drinking, and Underage Person in Place of Sale. He was ordered to pay $570 in fines.
