On September 22, 2024. An officer from the Owen-Withee Police Department conducted a traffic stop on a vehicle that was traveling 57 MPH in a posted 25 MPH zone. The officer approached the vehicle and made contact with the female driver who identified herself as Elizabeth. She mentioned that she couldn't find her drivers license and said she was upset that she couldn't afford to buy cigarettes.
While speaking with Elizabeth, the officer detected an odor of intoxicants coming from the vehicle. He then noticed a pill bottle on the passenger seat and Elizabeth explained that it was her prescription. The officer told Elizabeth that he was concerned with her driving behavior due to her driving double the speed limit with kids riding their bikes on the shoulder of the road. While looking for her drivers license, Elizabeth pulled out her birth certificate and social security card. The officer was able to positively identify Elizabeth and discovered that she had four prior OWI convictions, a revoked driving status, and also a .02 BAC restriction.
Elizabeth showed signs of impairment and was asked to step out of her vehicle and walk towards the front of the squad car. The officer asked if she would be willing to perform field sobriety tests and Elizabeth initially stared at the officer without saying anything. The officer then explained that he understood that she may be emotional and if she wanted to talk about her issues, he would be willing to listen. Elizabeth finished her cigarette and agreed to do the field sobriety tests. Elizabeth failed the tests and was asked how much she had to drink. She replied, "Not enough". The officer then asked Elizabeth if she would provide a preliminary sample of her breath, which she denied.
The officer then told Elizabeth that she was under arrest and asked her to place her hands behind her back. Elizabeth asked if she could smoke another cigarette and the officer allowed her to do so. While standing next to the squad car, Elizabeth appeared to be getting more upset and mentioned that she was probably going to prison. After the cigarette, Elizabeth was secured in handcuffs and placed into a squad car.
A K9 was ran around the vehicle and did not alert. The officer read Elizabeth the Informing the accused verbatim and she began yelling and swearing. Elizabeth was then asked if she would be willing to provide a sample of her blood to which she said yes. The officer escorted Elizabeth to the hospital for a blood draw before transporting her to the Clark County Jail. The blood tests results later showed that she had a.197 BAC. Elizabeth was found guilty for operating with a prohibited alcohol concentration (5th offense). She was sentenced to 18 months in prison and 5 years of extended supervision.
