On July 3, 2024. Officers from the Oshkosh Police Department responded to an assault complaint. When officers arrived, they observed a male on the ground who was conscious and breathing but in pain. EMS arrived on scene and provided treatment to the victim. A witness stated that he saw a male (Kyle) on a motorcycle revving his engine. He then made a comment to Kyle that he could get in trouble for doing that. Kyle then punched a random man in the face approximately 4 times before leaving. Another witness came back to the scene and showed officers a recording of Kyle on a red motorcycle punching the victim in the face. The witness also made a comment that Kyle was possibly intoxicated as he smelled of alcohol and was slurring his speech.
Based on the footage shown by the witness, officers were able to positively identify the suspect as Kyle. A records check revealed that he was on probation and owned a red, 2017 Yamaha FZ09. Shortly later, observed the motorcycle and attempted to conduct a traffic stop. The vehicle drove around a squad car, and accelerated at a high rate of speed. Other officers located the bike, however the operator kept taking off and escaping.
Officers responded to Kyle's residence and observed a male in the driveway. The male stated that he was a friend of Kyle and explained that Kyle called him and told him to open the garage door. The male was informed that Kyle had been fleeing from officers and was asked to close the garage door and go inside. As the garage door was closing, officers could hear the motorcycle approaching. Officers concealed themselves behind garbage cans and waited for the motorcycle to stop. Once the motorcycle was in the driveway, officers ran at the operator and tackled him off the motorcycle. Officers removed his helmet and he was confirmed to be the same male who was recorded earlier in the day.
Nothing of evidentiary value was located on Kyle’s person or in his backpack. Kyle denied doing anything and stated that his friend had no clue what was going on. Kyle was taken to the hospital for a blood draw before being transported to the Winnebago County Jail without incident. The blood results from the crime lab showed that Kyle had a .174 BAC. Kyle was found guilty for Vehicle Operator Flee/Elude Officer and OWI (4th). He was sentenced to 24 months in jail and ordered to pay $3,800 in fines.
