On February 6, 2024. An officer from the Portage Police Department observed a vehicle make a left hand turn into the far-right hand lane. The officer got behind the vehicle and performed a DOT check on the registration, which came back as expired. A traffic stop was conducted and the operator was identified as a man named Robert. He stated he was lost and stated that he was borrowing the vehicle from his buddy Alex, however he was not listed as a registered owner.
The officer stated in his report that “With Robert's odd route of travel, him stating he was trying to get on the highway, but also trying to meet a friend here in town, as well as the freshly lite cigarette, which I recognized through my training and experience as what some people utilize either trying to conceal odors emitting from the vehicle, their breath, or have utilized them when they are nervous about police contact, I knew something was not right and wanted the canine.”
Dispatch advised that Robert was currently on probation for Vehicle Operator Flee/Elude, Secondary Recklessly Endangering Safety, Burglary, Driver Operator without Consent, and Felony Bail Jumping. Officers asked for the keys to the vehicle to eliminate the ability for Robert to initiate a pursuit by fleeing the scene of the traffic stop. After seeing that Robert was currently out on bond from Juneau County for two misdemeanor cases and one felony case, which two of them being for Operating After Revocation with conditions not to drive without a valid license, it was decided Robert would be taken into custody for initially the misdemeanor and felony bail jumping along with Operating After Revocation.
Robert was asked to exit the vehicle and walked to the front of a squad car. A search of Robert's person did not reveal anything of evidentiary value. An officer asked Robert if there was anything in the vehicle that they needed to be concerned about or if he had anything hidden on his person. He stated there was not. Robert was asked if officers could move the vehicle closer to the curb, which he denied. Robert stated he could not give permission as he wasn't the owner and didn't know what was in the vehicle. Robert's was secured in a transport belt and placed into a squad car.
The canine alerted to the presence of a controlled substance within the vehicle, and a probable cause search of the vehicle was conducted. In the center console, officers located a glass bulb style pipe that is commonly used for smoking methamphetamine. Upon further inspection of the glass pipe, it appeared brand new and had not been used. It also did not have any sort of residue or substance within it. An officer who did not have his body camera activated at the time located a black magnetic box that was filled with numerous items of suspected drug paraphernalia and controlled substances were also located. Robert was then transported to the Columbia County Jail and turned over to jail staff.
On the way to the jail, Robert asked about his phone and wallet. The officer forgot about those items and had to stop to retrieve them from the hood of the squad car. Once in the booking room, Robert said that he would be withdrawing from heroin use. Jail Staff advised that a bag of suspected controlled substance was located during a strip search on Robert's person concealed in his groin area.
All evidence items with weights were tested utilizing a Digit Z Scale. The evidence included:
A small black magnetic box that had miscellaneous items of drug paraphernalia.
A small blue gem baggie with a purplish powdery yet with solid chunks of substance that tested positive for heroin - 0.4 grams
Plastic bindle of what appeared to be a baggie corner with the same type of purplish powdery substance that also tested positive for the presence of Heroin - 0.8 grams
Another blue gem baggie with the same purplish powdery substance that tested positive for the presence of Heroin - 0.5 grams
Small piece of tin foil that was folded and contained a black crystally substance that tested positive for the presence of Fentanyl - 0.3 grams
Plastic baggie of a white crystally substance that was located on Robert's person concealed at the Columbia County Jail. This substance tested positive for the presence of Methamphetamine - 15.1 grams
Robert was found guilty for Possession with Intent to deliver Amphetamine/ Methamphetamine/etc (10-50g). He was sentenced to 120 days in jail and ordered to pay a $518 fine.
