On July 3, 2025. An officer from the Darlington Police Department observed a vehicle driving erratically. Moments later, the driver (Daniel) pulled up to the officers squad car and stated that he was lost. The officer then exited his squad car and approached Daniel’s vehicle where he observed an empty six pack and noted that his eyes were bloodshot and glassy.
When asked how much alcohol he had consumed, Daniel stated he drank one beer at a bar in Hazel Green. The officer detected a strong odor of intoxicants and returned to his squad to conduct a record check on Daniel. It was discovered that Daniel had three prior OWI convictions and was currently on probation.
Daniel then agreed to perform field sobriety tests and admitted he had consumed two beers, rather than the one he initially reported. He agreed to give a PBT sample which showed an estimated BAC of .094%. The officer then determined that Daniel was impaired and placed him under arrest. He was secured in handcuffs and placed in the back of a squad car.
The officer then deployed his K9 partner (Ace) who alerted to the presence of a controlled substance in the vehicle. However, a subsequent search did not reveal anything of evidentiary value. A tow truck was then called and removed Daniel’s vehicle from the scene.
Daniel consented to a blood draw which later revealed he had a .091 BAC at the time of the incident. He was found guilty for OWI (4th) and sentenced to six months in jail along with three years of probation.
