On September 11, 2024. Officers from the Jackson Police Department were dispatched to a Piggly Wiggly for the report of a shoplifting suspect. When officers arrived, they met with a store owner and the suspected shoplifter (Andrew). The owner explained that he saw a male putting items into piggly wiggly bags before walking out without paying.
Andrew initially denied attempting to steal anything and provided his ID. The officer explained that the store had cameras and that they would find out if he tried to shoplift. After further questioning, Andrew finally admitted that he intended to leave Piggly Wiggly without paying for the goods. He stated that he never left the building, but the officer explained that the state statue for retail theft only requires the intent to steal.
An employee was able to go through the shopping bags that Andrew was using and determined that he attempted to steal $134.09 worth of goods. The store owner recognized Andrew as a regular customer and asked if he had stolen from Piggly Wiggly in the past. Andrew was initially hesitant to say, but eventually admitted to stealing from there prior to this incident.
Officers told Andrew to exit the building and began searching him. Andrew mentioned that he walked to the store but officers did not believe that to be true, as it would have been extremely difficult to walk with the amount of items that he tried to take. Officers also noted signs of impairment and asked Andrew if he had been drinking. He responded “Does it matter? I'm of age.” An officer replied that it did matter if there was surveillance footage of him driving to Piggly Wiggly.
Andrew continued to deny driving and officers decided to review store surveillance footage to see if they could see him driving. Andrew was then secured in handcuffs and placed into a squad car. Officers then began to question if he did actually walk there as he was not in possession of any car keys. An officer then began checking license plates in the parking lot and found a rental car that was currently being rented by Andrew. A plain view search of the vehicle received an open alcohol container in the cup holder. The officer opened the door and located the keys inside.
Officers told Andrew to stop lying and asked what he wanted to do with the vehicle and its keys. Andrew continued to deny driving and officers decided to conduct field sobriety tests. He failed the tests and agreed to provide a PBT breath sample. The PBT showed a result of .329, and Andrew was again secured in handcuffs before being placed into a squad car. He was transported to the hospital for a blood draw before being released to staff at the Washington County Jail. Andrew was found guilty for retail theft and OWI (4th). He was sentenced to 2 years in prison, 9 months in jail, and 3 years of extended supervision.
