On Friday, March 8, 2024, at approximately 2104 hours, I was dispatched for a report of a physical altercation. Upon arrival, I observed a female standing in the doorway of the residence yelling at another female.
She told me that I do not pay her rent and proceeded to try to close the door, but I stepped into the doorway and put my arm up to prevent the door from closing. She then pushed my left arm and struck me with a closed fist.
At this point, I said she was now under arrest and pulled her from the doorway in an attempt to gain control of her and place her in handcuffs, but she began to physically resist by pulling away, tensing her arms, and falling to the ground. She continued to scream "don't touch me" and pull away, not letting me handcuff her despite multiple times me telling her to stop resisting.
I instructed her to put her hands behind her back, but she continued to forcibly pull away. She was able to stand up, so while maintaining control of her wrists, I pushed her against the wall to attempt to regain control of her, and she tried to kick me with her left leg. She was then taken to the ground where she continued to scream and forcibly resist. I called for backup and continued to give her verbal commands to stop resisting.
She continued to scream and called me a “racist”. She then ran towards the rental office. She was located at the main entrance of the rental office, kicking the door and screaming for help. Because of her earlier spitting at me, I pushed her head towards the ground to prevent her from spitting at me again. She went to the ground, and I attempted to roll her onto her side, but she continued to scream and forcibly resist. I attempted to calm her down by lowering my voice and talking to her, but she would not stop crying and screaming. She then tried to kick me in the head by kicking behind her back while I was leaning over to hold her. She said, "now I'm spitting at you," and then spit at me. A spit mask was put on her, and the N-95 was removed.
Swain continually kicked the interior of car #77, which resulted in the interior bars of the rear door being bent outward. She was also clearly intoxicated and had the odor of an alcoholic beverage emanating from her breath. At this point, she was clearly a danger to herself and others, and the decision was made to transport her directly to Morristown Medical Center.
I returned to police headquarters and prepared complaint summons for Aggravated Assault (2C: 12-5b5), Resisting Arrest by Flight (2C: 29-2a2), Throwing Bodily Fluids at Law Enforcement (2C: 12-13), Criminal Mischief (2C: 17-3a), two counts of Obstruction (2C: 29-1a), Hindering (2C: 29-3b2), Harassment (2C: 33-4a), Disorderly Conduct (2C: 33-2a1), and Resisting Arrest by Force (2C: 29-2a). She was also issued motor vehicle summons for Pedestrian Failure to Use a Crosswalk (39: 3-34). She was given a court date.
At the completion of our investigation, we were unable to determine to what extent the altercation occurred because neither sister was cooperative or would provide a statement. We did receive confirmation that the child was located at the school in their town and was turned over to his grandmother. All required reports were sent to the Morris County Prosecutor's Office.
