Officers responded to Mcdonald's for a report of a female individual that had passed out in her vehicle. On arrival, I spoke with the caller/employee who stated that the female was now awake. It was reported by employees they also exited the building because they believed there was an individual at the drive-thru, however they were not responding to questions. I then made contact with the driver. I did not observe the odor of an alcoholic beverage while speaking with her. I asked if she had taken anything today to consume alcohol or narcotics, she stated no. I asked her to step out to the rear of her vehicle so I could determine if she was impaired in any way. I asked if she had taken any medication and she stated no prior to operating her vehicle. I advised I would be checking her eyes and she responded she stood with her feet together, hands at her side. I observed equal tracking in both eyes and equal pupil size in both eyes. I also observed a lack of smooth pursuit in both eyes, nystagmus at maximum deviation in both eyes, nystagmus prior to 45 degrees, and no vertical nystagmus.
She stated she did not have any medical issues that would prevent her from being able to perform the test. Kristen advised she had been to the hospital recently, for mental health reasons. During this time she advised that she had been given various prescription medications. I then explained the walk and turn test. I had her stand with her arms down and demonstrated the starting position for the walk and turn test.
She was arrested for OUI-LIQUOR OR .08%, handcuffed, double-locked, and placed into the rear compartment of car E17. She stated she wished to be seen by EMS. She spoke with EMS and during this time she declined further treatment. The car was inventoried by SPC Towing. At this time, she was advised that she had now been charged under the new OUI law which was MUPOM TOWING. At HQ, Ptl. Manochio conducted the 20 minute observation and operated the Alcotest. Another officer arrived to assist and advised me he had recently dealt with her on 01/01/24 at approx. 0200hrs and transported her to SEMC via ambulance. I issued the woman 131292409201 (90-24-D), 131292409202 (90-13-B), and 22112409203 (90-24-E). She was released after signing off on the state's potential liability form.
