On July 22, 2023, at 21:57 hours, an officer was dispatched to East Saddle River Road and Hollywood Avenue following a request from P.O. Kirk. Upon arrival, the officer found a vehicle with being inspected by P.O. Strasser and P.O. Kirk. P.O. Strasser had noticed the vehicle stationary on the road with other vehicles passing it.
Upon further investigation, an odor of alcoholic beverage was detected emanating from the vehicle. The driver was asked to exit the vehicle for a sobriety test, which she consented to, acknowledging that the body-worn camera (BWC) was recording. She mentioned she was returning from a baby shower and had consumed one beer around 12:00 PM. Despite her claim, a strong odor of alcohol was noticeable from her breath.
She underwent a series of field sobriety tests: the Horizontal Gaze Nystagmus (HGN), Walk and Turn, and One Leg Stand tests, which indicated signs of impairment. Consequently, Aurora was determined to be driving under the influence (DUI) and was arrested. Despite an attempt to provide breath samples for the Alcotest, all her attempts were insufficient, leading to an additional charge of refusal.
Following the arrest, her vehicle was impounded, and she was transported to police headquarters for further processing, where she was read her rights and agreed to provide breath samples. However, her inability to provide adequate samples resulted in a refusal charge. She was also given a copy of the John's Law Potential Liability Warning Form. The incident concluded without further occurrences.

39:4-50.4a (Refusal to Submit to a Breath Test)
39:4-97 (Careless Driving)
39:4-56 (Delaying Traffic)
39:4-88 (Failure to Keep Right)

39:3-29C (Failure to Exhibit Documents - Registration)
