On December 1st, 2023, around 2100 hours, Officer Specialist Folin Christmas was conducting routine patrol duties, traveling south on Carlin Rd. During this patrol, a 2005 Chevy 4 Door approached with its high beam headlights activated. Despite Officer Christmas's observation that the vehicle failed to dim its headlights, it continued past. Responding to this violation, Officer Christmas turned around and initiated a traffic stop, which led the vehicle to turn right onto Walt Lane and come to a stop.
Upon interaction with the driver, Officer Christmas detected a strong odor of an unknown alcoholic beverage emanating from her breath. The driver, identified as REDACTED, exhibited bloodshot and watery eyes, along with slurred speech. Initially denying alcohol consumption, the driver later admitted to drinking when questioned. Officer Christmas requested the driver's license, registration, and insurance card, receiving the license but not the current insurance card or registration. The driver's daughter was called to the scene to provide the missing documents.
Observing signs of impairment such as difficulty balancing, swaying, and unsteadiness on her feet, Officer Christmas instructed the driver to exit the vehicle. During this process, the driver expressed concerns about her status as a convicted felon and anticipated arrest due to alcohol consumption. Subsequently, Officer Christmas read the driver her Miranda Rights and inquired about her alcohol consumption, to which she admitted drinking at a local establishment and at home earlier in the evening.
Following her arrest for DUI based on observations, field sobriety tests, and Officer Christmas's training and experience, the driver became increasingly agitated, displaying extreme mood swings and directing racially charged language towards Officer Christmas. Despite her continued hostility, she was transported to Putnam County Jail, where she was offered a breath test, which she vehemently opposed.
Throughout the transport, the driver maintained her belligerent demeanor, expressing anger towards Officer Christmas for her arrest and making derogatory remarks about law enforcement.
