On July 28, 2023, at approximately 1600 hours, Officer Joseph Brooks and Officer Theodore Mursch of the Florida Fish and Wildlife Conservation Commission (FWC) were on routine marked vessel patrol at Crab Island, in Okaloosa County, FL. They conducted a vessel stop and subsequently arrested the operator for boating under the influence. They observed a vessel, a 22’ pontoon with the registration REDACTED , on full plane traveling north on the east side of Crab Island. Officer Mursch activated the emergency lights, maneuvered the patrol vessel, and conducted the vessel stop. As he approached the vessel, he observed Mr. P changing positions with one of the other occupants onboard. Officer Brooks verbally notated the change of operators on his assigned body camera, as Mr. P took the helm of the vessel. The vessel continued to violate the idle speed zone with Mr. P as the operator.
Officer Mursch pulled the patrol vessel alongside the pontoon, identified himself, and secured both vessels together. He made contact with Mr. P and referred to him as the captain for the remainder of the stop.
During the personal contact with Mr. P, Officer Mursch observed him swaying side to side with a wide stance. He informed Mr. P of the reason for the stop and requested his driver’s license. Mr. P initially handed over his wife's driver's license, but Officer Mursch clarified that he only needed Mr. P's license, which Mr. P then retrieved from his wallet.
Officer Mursch detected the strong odor of an unknown alcoholic beverage emanating from the vessel and observed several empty containers on the vessel's floor. He asked Mr. P to retrieve a life jacket for everybody onboard, during which Mr. P displayed difficulty maintaining balance.
As Officer Mursch conversed with Mr. P, he noticed Mr. P's glassy and slightly bloodshot eyes, along with his lack of balance and inattention to the idle speed zone. Officer Mursch inquired about Mr. P's alcohol consumption, to which Mr. P responded, “The captain has.”
Mr. P consented to sobriety tasks, and Officer Mursch proceeded with the standardized field sobriety tasks (SFSTs). Multiple clues indicating impairment were observed during the tasks.
Following the SFSTs, Mr. P became belligerent and irate, resisting Officer Mursch's instructions. Despite attempts to calm him down, Mr. P continued to resist and yell, prompting Officer Mursch to inform him of his impending arrest for boating under the influence.
During transport to the US Coast Guard station, Mr. P made several provocative and racist remarks. He also exhibited emotional outbursts, alternating between calm and irate behavior.Upon arrival at the Coast Guard station, Mr. P resisted following commands and was physically guided into a chair by Officer Mursch. Despite being offered the opportunity to provide a breath sample, Mr. P refused.
Mr. P's aggressive behavior persisted during transport to the Okaloosa County Jail, resulting in Officer Mursch and Officer Brooks needing to restrain him. Due to his behavior, the South annex refused to accept custody, and Mr. P was ultimately booked at the Crestview jail.
At the jail, Mr. P was evaluated by medical staff for complaints about his shoulder and knee. However, his irate behavior hindered the medical staff's ability to obtain vitals.
Mr. P was issued uniform boating citations for various offenses, including operating a vessel while impaired and resisting arrest without violence.
