On February 24, 2024. Officers from the Lake Geneva Police Department were looking to make contact with a man named Tyler in regards to a possible theft, he was last seen driving a blue BMW. An officer located a vehicle matching the description and when he activated his emergency lights, the driver began fleeing at a high rate of speed. Officers lost sight of the vehicle before locating it shortly after parked at a motel. The BMW was unoccupied and had the wrong license plates displayed. Officers made contact with the occupants of the motel unit that the vehicle was parked in front of. Desirae and Giovanni, who were both identified from previous police contacts were inside and stated that they did not know anything about the vehicle. They also said that nobody else was inside. Desirae was asked if she knew anybody named Tyler and she explained that her step fathers name was Tyler. An officer asked if he was there and Desirae stated "100% positive he is not here” and claimed she hasn't talked to him in a couple days. Officers decided that due to the pursuit involving the BMW, it would be towed since they couldn't confirm the driver or owner. One officer stayed on scene watching the entrance to the residence while the other officer left and later returned in an unmarked squad car. He sat in the parking lot of the motel watching Desirae's unit and the parking area where the BMW had been towed from. Dispatch advised that a male by the name of Frank wanted to speak to an officer regarding the towed vehicle. An officer called Frank who stated that he was the vehicle's owner. The officer advised that until he provided proof that he was the owner, he would not release any information. Frank then said he was at room 215 at a different motel and agreed to meet with an officer. When the officer arrived at the motel, he learned that there was no room 217 and that the rooms ended at 213. Frank was then provided a phone number that he could send proof of ownership to, he sent a photo of Tylers drivers, not his own with the message, "I want my suv dropped off right where it was towed from. Wasn't even illegally parked." While watching Desirae’s residence, an officer observed a white Trailblazer pull into the motel. He then observed a male subject exit the residence and got in on the passenger side of the Trailblazer. The vehicle then pulled out onto the street and an officer initiated a traffic stop. Tyler was located sitting in the front passenger seat and tried to flee on foot. An officer tackled Tyler who was physically resisting. Multiple law enforcement officers and one citizen were able to get him into custody. During the altercation, the female driver of the trailblazer was yelling at officers and stated that officers had no right to tow the vehicle. An ambulance was then requested because Tyler stated that he could not breathe. Desirae came down to the scene wearing no socks or shoes, she was upset about the citizen that assisted in detaining her father. A search of Tyler revealed a cell phone, and car keys found in his front pants pocket. Detectives later learned that the keys belonged to the seized BMW which also contained identifying documents inside indicating Tyler was the owner. He was taken to the hospital before being transported to the Walworth County Jail. Tyler was found guilty for Vehicle Operator Flee/Elude Officer, a class I felony, he spent 115 days in jail and received a 5 year probation sentence. His step daughter Desirae was found guilty for Resisting or Obstructing an Officer and ordered to pay a $1083 fine.
