On March 12th, 2025. An officer from the Sun Prairie Police Department attempted to conduct a traffic stop on a red SUV with no plates. As the officer activated his emergency lights the driver (Elvia) refused to pull over and failed to stop at stop signs. Shortly later, Elvia parked in front of an apartment and exited her car. Officers immediately approached and secured her in handcuffs.
While speaking with Elvia, officers detected the odor of alcohol along with numerous signs of intoxication. She appeared to be very distraught and officers had her sit on the curb. After calming down, officers agreed to remove the handcuffs for questioning.
In the meantime, the Sun Prairie Police Department received a report that a child had been attacked by his mother. The address was at the same apartment building where Elvia had parked, and officers on scene responded to the residence. Officers met with a male named Raphael who explained that Elvia was the mother of their young child and said she had just left the apartment complex shortly before fleeing from the officers.
Raphael stated that he and Elvia had been arguing when she became upset and allegedly began squeezing their son for several seconds. He explained that he took the child away from her because he was afraid Elvia was going to hit him. Elvia then got into the vehicle and left the apartment complex. Sun Prairie Paramedics arrived on scene and noted that the young child did not have any major injuries and appeared to be healthy. Raphael stated that he did not want to press any charges and went back inside the apartment with his son after being medically cleared.
While officers attempted to get a statement from Elvia, she kept saying “He set me up” and tried yelling at Raphael who was in an ambulance with their son. When asked if she would perform field sobriety tests, Elvia declined and officers secured her in handcuffs before placing her into a squad car. Elvia was transported to the Sun Prairie Police Department where she agreed to provide a breath sample for the intoximeter which showed a .170 BAC. She was then transported to the Dane County Jail and released to jail staff. Elvia was found guilty for OWI (2nd) and was sentenced to 60 days in jail
