This is just an initial peek at this lawsuit. While the writing is getting better, there are still problems with how it is drafted. I will get into some of that, and why I think this complaint will be subjected to various attacks, including Rule 12(b)(6) and anti-SLAPP grounds. Chille admits this is a first amendment case, and that brings in petitioning activities, all of which can be subject to an anti-SLAPP dismissal motion. The big problem – besides dismissing a defendant right away – are the anti-SLAPP attorney’s fees which will be owed by Chille, even if the complaint is only partially dismissed as to one or more claims, but less than all. Each motion can come with a hefty $50K in legal fees, and if he defeats the anti-SLAPP, no fees are awarded to him. I will await the inevitable pleading challenges, and do an update video.
