Do You Own the Beach? Constitutional Stand Ends in Arrest  @EyesofanOfficer

On August 30, 2023, I was dispatched to L Street Beach in response to reports of a disturbance involving an intoxicated individual refusing to comply with lifeguard instructions. Upon arrival, I observed the suspect sitting on the sand, yelling at both the officers and the lifeguards. The lifeguard captain informed me that the suspect had made threats, including saying he would "choke the lifeguards" and that they would "never see the light of day again."

I approached the suspect, who continued to shout and refused to identify himself. Despite my efforts to de-escalate the situation, the suspect became more agitated, and I detected a strong odor of alcohol. The suspect ignored my commands and attempted to walk away from me. When I attempted to detain him, he resisted arrest and tried to pull away. With the assistance of other officers, I was able to restrain and handcuff him. The suspect continued to resist throughout the transport to the station and during booking. He was ultimately lodged in the Ocean County Jail, and a "use of force" report was filed in accordance with department policy.
