On August 23, 2024. An officer from the Whitefish Bay Police Department attempted to conduct a traffic stop on a gray Kia Forte without any taillights on. The Kia momentarily slowed down and braked before increasing its speed and fleeing, exceeding speeds of 70 MPH in a posted 30 MPH zone. The driver (Dominick) crossed double yellow lines to pass vehicles. An officer from the Shorewood Police Department was able to successfully deploy stop sticks, deflating the front tires of the Kia. The Kia began to slow down and pulled into the dead-end parking lot of Corner Bakery. Dominick opened his door as the car was still rolling and put his hands up before stopping.
Officers conducted a high risk traffic stop and ordered Dominick to exit the vehicle and walk back to them. Dominick complied and was searched before being secured in a squad car. Nothing of evidentiary value was located on his person and it was determined that Dominick was the only occupant of the vehicle. A search of the vehicle revealed two plastic baggies containing a green leafy substance. The substance later tested positive for THC and weighted 7.4 grams.
Dominick was transported to the Whitefish Bay Police Department where officers observed him to be slow and lethargic. His speech was slow/slurred and his eyes were glassy. When asked, Dominick stated that he smoked marijuana approximately 6 hours prior. Dominick initially agreed to field sobriety testing but later refused to finish the tests. He said he did not consume any alcohol and agreed to a PBT test which showed a 0.00 BAC.
Dominick refused to submit to a blood draw and officers were able to get a warrant for his blood. He was taken to the hospital for a blood draw before being transported to the Milwaukee County Criminal Justice Facility where he was turned over to staff. Dominick was charged with felony fleeing and Operating With a Restricted Controlled Substance after a blood draw revealed the presence of THC. He was found guilty for Operating a Motor Vehicle in an Attempt to Elude an Officer. Domincik was sentenced to 28 months in prison and 24 months of extended supervision.
