On November 2, 2023. Dispatch advised that they had received a driving complaint. The caller said that a vehicle was swerving off of the roadway. An officer from the Johnson Creek Police Department located the reported vehicle trying to leave a parking lot but the driver was using the designated entrance blocking other vehicles. The officer made contact with the driver (Jesus) and detected the odor of alcohol. Jesus was asked to remove his sunglasses and put his truck in park. He said that he does not speak English very well but was able to understand the officer's requests. The officer noticed food spilled over Jesus’s lap and a Culvers bag in the passenger seat. She went back to her squad car to get a handheld translator (Pocketalk). Using Pocketalk, the officer was able to gather Jesus’s information and inform him on why he was stopped. When questioned, Jesus admitted to drinking and was asked to step out of the vehicle to perform field sobriety tests. He was unable to complete some of the tests and a PBT test was admitted which showed a BAC of .303. Jesus said that he thought he had four priors but he actually had 5 previous OWI’s. Two open containers that were still cold were located in the cupholder and multiple other empty and unopened alcohol containers were located in the truck. Jesus was found guilty for OWI (6th). He was sentenced to 24 months in prison, 30 months of probation, and ordered to pay $8829 in fines and fees.
