Bodycam Video - Florida Fish & Wildlife officers were participating in a Boca Bash detail and patrolling the waters of Lake Boca with other officers. They were ensuring that everyone attending the event on the waters of Boca Raton was operating their vessels in a safe manner.
At approximately 1845 hours, while observing a large volume of boaters, the officers noticed a personal watercraft (PWC) with a female operator and a male passenger violating the speed zone. As they approached the vessel, they observed the couple exchanging a long kiss while the vessel was still in motion. The operator failed to maintain a proper lookout while operating the vessel and did not see the patrol vessel before quickly accelerating the throttle and heading away. The captain initiated the siren to catch her attention. The operator was slow to respond, even after the public address system was used to signal her to stop. She finally responded after being told several times to come to the patrol vessel's location.
It became apparent that the operator was no longer in control of the vessel as the male passenger had reached forward and operated the PWC to the side of the marked patrol vessel. Upon contact with the operator, it was noticed that her personal flotation device (PFD) was not secured to her body. She also had a blue wristband attached to her right wrist, a lanyard (kill switch) on her left wrist, and a black whistle attached to the lanyard. Additionally, there were two thermoses on the starboard side of the PWC.
While alongside the patrol vessel, the operator spontaneously stated that she did not know she wasn't allowed to go fast and admitted that she did indeed go "fast." Her passenger also mentioned that he had informed her after being told she was speeding. When questioned about why they had switched operators, the operator appeared confused. She stated her identification was on her boat, and her passenger’s wallet was in the center console. It took her longer than expected to retrieve the wallet. When asked about the blue wristband, she mentioned it was from the pier but later said she did not remember. Additionally, the operator spelled her first name incorrectly during the identification process.
During a boating safety inspection (BSI), the operator exited the PWC and entered the patrol vessel while her passenger retrieved the fire extinguisher. As she stood beside one of the officers, a strong, distinct odor of an alcoholic beverage was detected on her breath.
Based on all observations and the operator’s performance during the Standardized Field Sobriety Tests (SFSTs), she was arrested for boating under the influence of an alcoholic beverage to the extent that her normal faculties were impaired beyond the safe operation of a vessel. She remained cooperative and compliant throughout the investigation but refused to provide a breath sample to determine its alcohol content after being read Implied Consent. Afterward, she spontaneously stated that she didn’t drink much but admitted she had been drinking "of course."
The vessel was released to the Boca Raton Police Department at Wildflower Park, and the operator was taken into custody without further incident.
