On July 7, 2024, officers from the Florida Fish and Wildlife Conservation Commission (FWC) were conducting water patrol in the Destin Harbor, Okaloosa County, Florida. At approximately 5:38 PM, a 2013 24-foot Flote-Bote Harris Pontoon, registered as FL8564PM, was observed entering the Destin Harbor in violation of the idle speed no-wake zone. The vessel operator, a shirtless white male wearing colorful board shorts, was later identified through a Florida driver’s license.
The vessel was seen plowing past multiple other vessels that were complying with the no-wake zone. Officers initiated a stop after the vessel passed their patrol unit while violating the speed zone. After activating the siren to gain the operator's attention, the individual looked back but continued operating forward. Upon stopping the vessel, officers noted the operator's dazed appearance, bloodshot and glassy eyes, droopy eyelids, and unsteady movements. Multiple empty alcohol containers were observed on the vessel, and the operator exhibited slurred speech and a strong odor of alcohol.
During a boating safety inspection, the operator struggled to locate required safety equipment, fumbling with seat cushions and forgetting what was requested. Despite being fluent in English, the operator intermittently responded in Spanish. Throughout the interaction, the operator demonstrated signs of impairment, using fixed objects for support and fumbling with items.
When questioned, the operator admitted to having consumed alcohol but did not specify the amount. The individual agreed to step onto the patrol vessel for further evaluation. Officers noted a strong odor of alcohol from the operator's breath during the interaction. Sobriety Field Standardized Tests (SFSTs) were conducted, revealing significant impairment, including difficulty following instructions and unsteadiness while seated.
Based on the observations, the operator was arrested for boating under the influence at approximately 6:01 PM. The rental facility took custody of the vessel to return it safely to shore. The operator was transported to Coast Guard Station Destin, where implied consent for a breath test was read. Three breath samples were obtained using the Intox8000: the first sample at 6:46 PM registered 0.176 g/210L, the second at 6:49 PM registered 0.139 g/210L, and the third at 6:52 PM registered 0.151 g/210L.
During post-arrest questioning, the operator confirmed having consumed Bud Light and Corona Refresco, claiming to have consumed four beers but denied feeling the effects of alcohol. The operator stated belief in their ability to safely operate the vessel despite evidence to the contrary.
The operator was charged with operating a vessel with an unlawful breath alcohol level of 0.08 or higher and cited for violating the idle speed no-wake zone. The individual was transported to the Okaloosa County Jail Annex, where custody, along with personal property, was transferred to booking authorities.
