Breaking news, live from the studio: a federal appeals court just struck down key parts of New Jersey’s assault weapons ban and its 10-round magazine limit. The crew was in the middle of recording when the decision dropped, so they read it in real time with no preparation, because it is that important.
The Third Circuit held that New Jersey cannot erase the Second Amendment by attaching an inflammatory label to a common rifle, or by declaring that an 11th round in an ordinary magazine suddenly turns protected property into contraband. Judge Ariana Freeman, writing for the majority, said the text of the Second Amendment covers all magazines, not just the ones New Jersey decides are standard capacity. The record showed more than 100 million 30-round AR-15 magazines already in circulation, which is exactly why the court called them standard equipment for one of America’s most popular rifles.
Congratulations to the Second Amendment Foundation, the New Jersey Rifle and Pistol Clubs, and everyone who carried this fight. A few honest notes from the guys: this creates a circuit split and sets up the Supreme Court’s coming look at the Viramontes and related cases, but it does not change New Jersey law today, and parts of the challenge were sent back for more work. The fight is not over. We still have to teach people to shoot, get carry permits, win at the ballot box, and win on the culture.
