Florida Fish and Wildlife Officers were on uniformed water patrol in the area of Hernando Beach when they observed a vessel without an all-around white light after sunset.
Officers began to tie off to the vessel while another officer initiated a boating safety inspection. After securing the vessel, Officers started to observe the operator, noting his bloodshot, watery eyes and droopy eyelids. Additionally, the operator had a distinct smell of an unknown alcoholic beverage emanating from him.
Officers requested the operator to put on a life jacket and inquired if he had consumed any alcohol that day. The Operator admitted to having a few drinks earlier. Officers then asked the operator if he would be willing to perform a few tasks to determine if he was safe to operate the vessel, to which he consented consented. He was then assisted onto the patrol vessel and guided to the bow.
Throughout the encounter, the operator exhibited watery, bloodshot eyes, droopy eyelids, and a distinct smell of an unknown alcoholic beverage. Based on these observations and his performance during the Standardized Field Sobriety Tests (SFSTs), Officers determined that he was under the influence to the extent that his normal faculties were impaired beyond safe operation of the vessel. When requested to stand the operator began to plead not to be arrested. As Officers attempted to place handcuffs on him, the operator pulled away and jumped into the water.
Officers kept a light on the operator while he was in the water. He then removed his life jacket and swam underwater, attempting to evade the officers. Officers maneuvered the vessel close to him, and they commanded him to return to the vessel. Once close enough Officers managed to grab the suspect by his wrists and pull him back onto the vessel, and handcuff him.
The man was issued several citations: – operation of a vessel while normal faculties are impaired, and resisting arrest without violence.
