Police Catch Intoxicated Karen After Fleeing Boating Crash  @DonnyRapture

On July 20, 2024, a police officer with the Florida Fish and Wildlife Conservation Commission responded to a reported hit-and-run boating accident at the Lake Harris Hideaway restaurant in Lake County. The police found that the victims and a witness remained at the restaurant, where the witness had documented the registration numbers of the striking vessel, a yellow Tahoe, with a photograph. The vessel was registered to an individual with an address in Tavares, FL. Lake County Sheriff’s Office (LCSO) deputies arrived at the registered owner’s residence and observed the individual returning to the dock, still operating the yellow Tahoe vessel. After gathering information at the restaurant, the police officer proceeded to the residence to meet with the LCSO deputies, with the interaction recorded on body cam.
Upon arrival, LCSO deputies informed the police officer that they had observed the individual docking the vessel and had maintained visual contact until the officer’s arrival. The body cam footage captured the officer beginning to interview the individual and other occupants regarding details of the accident. The individual initially stated that they were leaving the restaurant, collided with another boat, felt threatened when several people insisted they stay, and felt intimidated by one witness openly carrying a holstered pistol (permitted under FSS 790.25(3)(h)). During the interview, which was recorded on body cam, one of the occupants, who claimed to be the only sober person on board, stated that they initially believed they had struck the dock but later learned it was another vessel.
When questioned about alcohol consumption, the individual stated they had consumed two alcoholic beverages that day. During a safety inspection, recorded on the body cam, the police officer observed signs of impairment, including bloodshot eyes, glassy and constricted pupils, and slurred speech. Additionally, empty alcohol containers were noted on the vessel, and a strong odor of alcohol was present. The individual needed reminders about required safety equipment, lost balance multiple times, and braced against solid surfaces.
Following the safety inspection, the individual completed a sworn statement, recorded on body cam. The police officer then expressed concerns regarding their sobriety, as it appeared their normal faculties were impaired while operating the vessel. The officer conducted seated field sobriety exercises, which included tests for horizontal gaze nystagmus, all captured on body cam. The officer observed a lack of smooth pursuit, sustained nystagmus at maximum deviation, onset of nystagmus prior to 45 degrees, and vertical nystagmus in both eyes. The individual needed reminders to keep their head still and follow the stimulus with only their eyes.
Based on the observations from the body cam footage, interview, safety inspection, and poor performance on sobriety tasks, the police officer placed the individual under arrest for boating while impaired. They were handcuffed, checked for tightness, and double-locked before being transported to the Lake County Jail, with the entire process documented on body cam. At the jail, the individual provided two breath samples with readings of .158g/210L and .159g/210L. They were subsequently charged with FSS 327.35(4) for a blood alcohol level of .15 or higher.
