The legal battle over South Africa's Expropriation Act continues as proceedings at the Western Cape High Court stretch beyond their originally scheduled hearing dates.
On day five of the constitutional challenge against the Expropriation Act, I returned to court in Cape Town to speak with AfriForum CEO Kallie Kriel and AfriForum's Ernst van Zyl about what happened inside the courtroom, why the hearing is expected to be postponed, and what comes next.
According to Kallie Kriel, the court has heard arguments from the applicants, supporting parties, and several government respondents. However, many respondents, including the EFF, have still not presented their arguments. With so many legal teams involved, finding a new hearing date could take months.
Kallie also explains why the Expropriation Act has not yet come into operation, despite being signed into law by President Cyril Ramaphosa. He discusses the implementation process, the role of the Minister of Public Works, and why the previous expropriation legislation remains in force for now.
Ernst van Zyl shares what stood out most during this week's proceedings. He discusses arguments presented by the President's legal team, the debate surrounding nil compensation, and why AfriForum believes its constitutional challenge remains strong. He also explains why the judges' interpretation of the law will ultimately determine the outcome of this important court case.
This case could have significant implications for property rights, land reform, expropriation legislation, and constitutional law in South Africa. While the hearings may be delayed, the legal challenge is far from over.
