“On Wednesday, March 12th, I Officer Haske was in full patrol uniform and operated marked patrol squad 3623 for the Village of Pleasant Prairie Police Department.
I observed a southbound vehicle at a high rate of speed. I paced the vehicle at speeds near 70mph in a posted 45 mph speed zone. I initiated a traffic stop on the vehicle. The defendant exited the vehicle and was immediately non-compliant. The defendant was later identified verbally as Simon and confirmed via DOT photograph after he was subsequently taken into custody.
As he spoke, I noticed that Simon's speech was rapid and slurred and his balance appeared poor. As I neared him, I smelled a strong odor of intoxicants emitting from his breath. Simon remained non-compliant and manipulated items both in his possession and near the front seat of his vehicle. I ordered him to stop and to step away, but he refused. Due to the passive resistance to my lawful orders and unknown items within his possession, I drew my E.C.D. (Electronic Control Device), and ordered Simon to stop reaching into his vehicle.
I continued to give Simon loud orders to step away from the vehicle, show me his hands, and to comply but he refused. I observed an unknown item in Simon's hands that was slim, silver, and pointed, which I believed was an edged weapon and could possibly be used to harm me. I ordered Simon to drop the items in his hands, which included the item, and after several lawful orders he did so.
At that time, I ordered Simon to face away from me so I could detain him based on the totality of the circumstances. I attempted to control Simon's arms and he pulled away and gave resistive tension to my control efforts. After backing away and drawing my ECD a second time, Simon complied to my orders to face away. I secured Simon's left hand in my handcuff and while attempting to place his right hand into handcuffs, he pulled away and gave resistive tension. Simon actively resisted my control efforts; however I was able to manipulate his right arm behind his back and secure him into handcuffs.
I attempted to escort Simon toward my patrol squad, however he continued to resist my control efforts, so I used a dynamically applied countermeasure of a Pull-in-Push-Down technique to decentralize Simon to the ground. While decentralizing Simon, he slipped his feet out of his slides, which caused both of us to fall faster than my effort at a controlled descent. I did not consent to any attack or injury by Simon at any time.
Once on the ground, I quickly checked my hands for injury and then assessed Simon for injuries. Simon continued to yell, and his speech was rapid. I rolled him to his sides to conduct a search of his person incident to arrest as well as to check for injuries. I did not observe any injuries to Simon's person and during the search, I did not locate any weapons or contraband. I maintained control of his person while also observing the scene for safety until Officer Martinez arrived to assist.
Officer Martinez and I attempted to stand Simon up using an assist-to-rise technique, however he did not comply and was lifted by us as he resisted. Sgt. Gates, Officer Thompson, and Officer. Longrie, along with an officer from the Winthrop Harbor Police Department arrived to assist.
Officer Martinez and I escorted Simon to the rear passenger seat of my patrol squad. Simon again resisted sitting in the patrol squad until he was assisted into the seat by Officer Martinez.
Officer Martinez and I conducted a probable cause search of Simon's vehicle. I seized two white pills and located an almost empty bottle of Crown Royal Whiskey (200mL) that was directly behind the center console and within reach of the driver-seat. I located a vehicle insurance card, which was expired as of 02/2024. The items were secured in my patrol squad until processed at the police department.
Due to Simon's threats of harm to officers, active resistance throughout the entire incident, and concerns for his safety, Officer Martinez rode as a passenger with me to the Kenosha County Jail. I transported Simon to KCJ without issue. Starting/ending time & mileage was recorded through dispatch.
At the jail, Simon was transferred over to jail staff with limited issues. Jail staff informed me that Simon provided a breath sample to them using their PBT which recorded a: 0.222% BAC. OWI paperwork including Informing the Accused, Warrant, and citations were left with jail staff.”
Simon was found guilty for “Resisting an Officer, Disorderly Conduct, and Operating While Revoked”. He was sentenced to 270 days in jail and ordered to pay $614 in fines.
