President Trump has issued another executive order aimed at limiting birthright citizenship. I support the objective. But after the Supreme Court's ruling in Trump v. Barbara, I don't believe this executive order has enough legal teeth to solve the underlying problem.
In today's show, I walk through Trump's attempt to identify additional categories of children who would not receive citizenship despite being born on American soil, including children of alien enemies, certain foreign government employees, and people participating in birth-tourism schemes. Some of those categories are already well established. Others appear designed to test how far the administration can push the exceptions the Supreme Court left behind—and I'm skeptical that the current five-justice majority will accept them.
But that doesn't necessarily make the strategy pointless. If an executive order creates another case, Trump gets another opportunity to put a slightly different birthright-citizenship question before the Supreme Court. Keep giving the justices opportunities to narrow or reconsider what I believe was a profoundly mistaken decision. Ultimately, I don't think an executive order or ordinary statute fixes this. The real solution probably requires the Supreme Court itself to correct the Supreme Court.
