According to a well known saying, sticks and stones hurt bones, but words don't hurt. Because words don't hurt, at least physically, they're not enough to justify the use of force in some jurisdictions.
The Louisiana case of Touchet versus Hampton provides an illustration.
Mark Hampton fired Purvis Touchet from his job at Hampton's car dealership.
A few months later, Touchet left Hampton several voice mails cursing, insulting, and antagonizing Hampton. Nine days after that, Hampton went to Touchet's new place of employment to tell Touche to stop calling.
When Hampton entered Touchet's office, Touchet was seated with his back turned.
Touchet then swiveled his chair around and yelled an obscenity at Hampton. Hampton immediately started punching Touchet and continued until Touchet's colleague pulled Hampton off. Touchet sued Hampton for battery.
At trial, two witnesses testified that Touchet never made an aggressive move toward Hampton on the day of the incident. Hampton argued that he punched Touchet in self defense because he felt threatened by the prior voice mail messages and the obscenity that Touchet yelled that day. Hampton then moved for dismissal.
The trial court found that Hampton acted in self defense and granted Hampton's dismissal motion. Touchet appealed to the Louisiana Court of Appeal.
