While Angela Graham was stationed at Camp Davis in Afghanistan, she was hit by a vehicle driven by a DynCorp employee.
At the time the accident occurred, Graham was an Oklahoma resident.
Graham sued two DynCorp entities, DynCorp International Incorporated and DynCorp International LLC for negligence in the United States District Court for the Southern District of Texas.
DynCorp Incorporated was essentially a shell holding company with limited activities related to the case.
DynCorp LLC's official headquarters was in Falls Church, Virginia, but the company had multiple multimillion dollar contracts with NASA in the Southern District of Texas.
The LLC also had administrative offices and extensive contacts in the Northern District of Texas.
DynCorp LLC claimed that it was not at home in the Southern District because the NASA contracts only accounted for a small percentage of its business. Both DynCorp entities filed motions to dismiss for lack of venue and, in the alternative, requested that the court transfer the case to the Eastern District of Virginia.
