Here's the lock and key. The Volcker Rule prohibits banks from proprietary trading in securities, derivatives, and futures. But the Clarity Act says tokens on a secondary market are not securities, they're digital commodities. And spot commodity transactions are not on the Volcker Rule's prohibited list. The gate is cleared.
So the same banks that can't prop trade Apple stock, that can't even underwrite or deal in equities inside deposit funded institutions, will be able to deal in and make markets in altcoins inside the bank where your deposits live. The Clarity Act gives banks broader authority over digital commodities than Glass Steagall ever allowed for stocks.
That's not a loophole. That's Fed orders, the Volcker Rule, and the Clarity Act fitting together lock and key. And the legislation that connects them all is sitting in the Senate right now.
