The Utah Supreme Court heard oral arguments Wednesday in the case of Douglas Stewart Carter, whose murder conviction was overturned last year after the court found police and prosecutors engaged in misconduct during the investigation and trial.

Carter, 71, has spent more than four decades on death row for the 1985 killing of Eva Olesen in Provo. Prosecutors are seeking a retrial and again pursuing the death penalty, despite recent crime lab findings that Carter's DNA was not found on any testable crime scene evidence.

The arguments focused on pretrial issues, including whether Carter's alleged confession should be suppressed and whether he should be granted bail as the case moves forward.
