On September 30, 2024, at approximately 2000 hours, two uniformed officers of the Florida Fish and Wildlife Conservation Commission (FWC) were conducting a land patrol at the 79th Street boat ramp located in Miami-Dade County, Florida. The officers conducted a vessel safety inspection on a personal watercraft (PWC) identified by its registration numbers. The owner and operator of the PWC was observed operating the vessel more than 30 minutes past official sunset.
During the safety inspection, the operator was uncooperative and refused to present a fire extinguisher that was visibly located in the front hatch of the PWC. He stated he preferred the officers pretend the extinguisher was not on board and issue a citation so he could leave for work. Additionally, the PWC lacked a required sound-producing device (whistle).
Upon conducting a license check through dispatch, it was discovered that the operator’s driver license had been suspended as of September 17, 2024, due to failure to pay traffic citations. While the officers were completing the citations, the operator drove his vehicle to the boat ramp to load the PWC.
The following citations were issued:
• State Statute 327.39(3): Operating a PWC at night (prohibited half hour after/before sunset/sunrise)
• State Statute 327.50(1)(a): Violation of vessel safety regulations (33 CFR & 46 CFR) – No sound producing device (33 USC 2001)
• State Statute 327.50(1)(a): Violation of vessel safety regulations (33 CFR & 46 CFR) – No fire extinguisher (46 CFR 25.30-20)
• State Statute 322.34(1): Unknowingly driving while license is suspended, revoked, or canceled
When the citations were explained, the operator was informed that he needed to sign the court copies. He refused to do so unless a supervisor was present. After being warned that refusal to sign the boating citations would result in arrest, the operator again refused and was placed under arrest.
