Courtroom Censorship: Cop Uses Protection Order to Silence Journalist (Part 1 of 7
On March 6, 2025, independent journalist Melissa Siljanovski and community advocate Dan Shook faced an unprecedented ruling in the Campbell County General Sessions Court presided over by Judge Bill Jones.
This video documents the legal arguments surrounding a 5-year extension of an order of protection sought by LaFollette Police Officer Anthony Mahar. Our defense attorney, Elizabeth Burrell, submits a formal legal memorandum establishing that journalistic video updates published to social media platforms are intended strictly for public consumption, do not constitute direct or indirect personal contact, and are fundamentally protected by the First Amendment.
Despite these clear constitutional protections, Judge Jones issued a sweeping 5-year extension, declaring that any future public commentary regarding the officer would be done at the reporter's "own peril."
To fully understand the gravity of this proceeding, the broader context must be examined:
The legal push began a mere two days after an explosive device was thrown and vehicle tires were slashed by a fellow LaFollette law enforcement official.
Officer Mahar filed the paperwork for this order on the exact day of the devastating Creekside Market fire and the tragic passing of Kelly Kehoe—effectively forcing an investigative reporter onto the defensive during a massive local news event.
Using a civil protection order allows public figures to enforce "prior restraint"—silencing a reporter completely—while bypassing the strict legal burdens of a standard defamation lawsuit. This sets a dangerous precedent that criminalizes public oversight and systemic reporting as a personal "obsessions" rather than community journalism.
This video is Part 1 of an 8-part investigative series exposing administrative retaliation, transparency failures, and law enforcement turnover in East Tennessee.
