WHAT IS A REGENCY and could Prince William, the Prince of Wales become Regent for King Charles III, in light of King Charles’s current health issues, specifically his cancer diagnosis in February 2024? The last Regency in the United was for King George III over 200 years ago, when his mental health problems led to his son, the future George IV, becoming Prince Regent for almost a decade. Prior to that, there had been a few situations in England in which a Regency had effectively been in force (though they were sometimes called Protectorates). These were for minors and for Henry VI in the fifteenth century, who also suffered a mental collapse. There were also numerous regencies in Scotland, including for Mary Queen of Scots and her son, James VI. In most such cases though these situations became very messy as members of the royal family and powerful landed magnates fought for control. It was also possible for the monarch to appoint a Regent when he knew he was going to be absent from the country for a periƒod of time. Henry VIII appointed his first and last wives, Catherine of Aragon and Catherine Parr to be Regents for instance and George II appointed his wife, Caroline of Ansbach, to the same position. In the reign of George VI however, Regency laws were created to smooth out the process. In this documentary from History Calling we look at the 1937 Regency Act and subsequent legislation from 1943 and 1953 to establish what is a Regency, when and why are Regencies used and could there be a Regency during the current reign? We’ll touch briefly on the Regencies and Protectorates of the past which I’ve just mentioned and on the existence of Counsellors of State, who can deputise for the monarch if he or she is temporarily incapacitated or absent from the United Kingdom. I’ll explain who the current Counsellors of State are (including whether Prince Andrew and Prince Harry are Counsellors of State under the present circumstances) and who would be Regent if King Charles was unable to fulfil the duties of monarch. I’ll also share some examples of times past when Counsellors of State have had to step in for the monarch and tell you what would happen if there needed to be a Regency for a minor and why Catherine, the Princess of Wales wouldn’t need to worry about losing custody of her children.
