Exciting news, as of yesterday Network Partners no longer have flagging disabled on their videos. It is not fair that people like me were protected while everyone else had to follow the rules. Based on what I have seen I don't think it would go well for either of them. My advice is to not go to court at all. Let her go and move on. Then again this is coming from someone who has had a feud online for the past 3 years so be sure to call hypocrisy on me for that one.

The system was originally designed for Network Programming such as television and or movies. However some Networks began offering this protection to user generated content and then obviously people were abusing the system.
It does appear that YouTube has taken ads off of my age restricted videos. While it does cost me money, it does level the playing field for everyone else. Here is one of my age restricted videos. youtube.com/watch?v=Rg6-7FyGHfo
