In an era of significant regulatory change, regulators, lawyers, the courts, and the public are faced with myriad and sometimes apparently conflicting considerations. This panel will explore how to navigate through the sometimes-rocky shoals shaped by recent and longstanding legislative enactments, judicial decisions, and executive actions as administrative agencies try to move forward with rescinding old regulations and enacting, enforcing, and defending new ones. For example, in the context of the regulation of nuclear power, materials, and waste, what level of deference is due to the NRC’s interpretation or enforcement of any existing or new agency regulations in light of judicial decisions such as Loper Bright, Seven County Infrastructure, West Virginia, and Siegel v. AEC, as well as the terms of the Atomic Energy Act of 1954, as amended; the ADVANCE Act; and the recent Executive Orders 14219 and 14300.
