Police Bodycam Footage of FWC Officers Arresting Woman for Boating under the influence. On Saturday, July 6, 2024, at approximately 6:00 PM, Officers from the Florida Fish and Wildlife Conservation Commission (FWC) were conducting a marked vessel patrol in Martin County, FL. While on the Intracoastal Waterway (ICW) near a notable residence, they observed a vessel (FL 4961 NW) traveling south. The officers conducted a stop for a vessel safety inspection and encountered the operator.
Several passengers aboard the vessel were seen with open alcoholic beverage containers, and a bottle of wine was on the deck. There was a strong odor of alcoholic beverages emanating from the vessel. The operator, who appeared to be unsteady while moving around and displayed signs of impairment (including glassy and bloodshot eyes), was asked for the required safety gear and a boater’s safety card, which was not provided. Due to these observations, the operator was asked to wear a lifejacket and come aboard the patrol vessel for Standardized Field Sobriety Tasks (SFSTs).

Once on the patrol vessel, the operator continued to display signs of impairment, including a strong odor of alcohol and glassy, bloodshot eyes. The officer had to repeat pre-task instructions several times due to non-compliance.
Horizontal Gaze Nystagmus
The operator exhibited a lack of smooth pursuit in both eyes, distinct and sustained nystagmus at maximum deviation, and early onset of nystagmus in the right eye. During the lack of convergence task, the right eye failed to move toward the center.

Finger-to-Nose Task
The operator struggled to follow instructions, began the task prematurely, used the incorrect hand, hesitated, missed the tip of the nose, and required repeated reminders to lower the hand after each attempt.
• Total Clues Observed: 23 (Threshold for impairment: 9)
Palm Pat Task
The operator did not complete the task satisfactorily, with improper hand positioning, rolling hands, and incorrect speed.
• Total Clues Observed: 4 (Threshold for impairment: 2)
Hand Coordination Task
The operator required multiple instructions, miscounted, improperly touched fingers, and ended the task in the wrong position.
• Total Clues Observed: 4 (Threshold for impairment: 3)
Arrest
Based on the failed SFSTs, visible signs of impairment, and observed behavior, the operator was placed under arrest for operating a vessel with impaired faculties. In the officer’s professional judgment, the operator displayed a high level of intoxication. Although some passengers claimed to be sober and capable of assuming control of the vessel, they also registered blood alcohol levels above the legal limit.
The vessel was towed to a marina and docked safely. The operator was read the implied consent warning and refused to submit to a breath test, which was recorded on the body-worn camera. After being read Miranda rights, the operator declined to answer questions.
The operator was transported to the local marina by vessel, then to the county jail for booking. The charges included:
1. Operating a vessel with impaired faculties (FS 327.35(1)(a))
2. Refusal to submit to a breath test (FS 327.35215(1))
