This case is raising major questions about surrogacy, parental rights, and who gets to make medical decisions for a baby before birth.
McKenna West, a cardiac nurse from Alaska, was a surrogate for a couple and during a 20-week ultrasound, doctors discovered the baby had hypoplastic left heart syndrome, a rare and serious heart defect.
According to court documents, the surrogacy agreement included a provision allowing the intended parents to ask West to terminate the pregnancy if a fetal abnormality was discovered. But West refused.
