Iowa tried to help enforce America's immigration laws. Federal courts stopped it. Now Senators Ted Cruz and Chuck Grassley are asking the Supreme Court to step in—and I believe this case exposes an extraordinary double standard in how federal courts have treated state immigration laws.
In today's show, I break down the amicus brief challenging the Eighth Circuit's decision against Iowa's immigration statute. The constitutional principle should be straightforward: federal immigration law is supreme, so states cannot enact laws that conflict with it. But what happens when a state law complements federal immigration law instead of obstructing it? Cruz and Grassley argue that courts have created a one-way ratchet where states trying to assist federal enforcement get blocked while sanctuary jurisdictions that resist enforcement are allowed to continue.
I also explain why the fight reaches back to the Supreme Court's 2012 decision in Arizona v. United States, the difference between facial and as-applied constitutional challenges, and why hypothetical future conflicts shouldn't necessarily justify wiping out an entire state statute today. If the Supreme Court takes this case, it could have consequences far beyond Iowa.
