The prosecution’s expert has now given the jury his bottom-line opinion on Lindsay Clancy: she was suffering from a mental disease when she killed her three children—but she was still criminally responsible for what she did. That’s the distinction at the heart of this entire trial. Mental illness by itself does not necessarily mean legal insanity.
In today’s show, I walk through the testimony that could prove devastating to Clancy’s defense. The expert concluded that she retained awareness that killing her children was illegal. He also found that although depression and hopelessness influenced her actions, she retained control over whether, when, and how she carried them out and whether to include her children. He believes the killings are better understood as part of a serious suicide attempt combined with what he calls “altruistic” killing—not as the product of command hallucinations.
I also examine the inconsistencies the expert found in Clancy’s account, her suddenly more guarded demeanor when questioning turned specifically to the killings, and the remarkable phone call she completed with her husband during the critical time period. Massachusetts requires the prosecution to disprove insanity beyond a reasonable doubt. This testimony may be the state’s strongest evidence yet that Lindsay Clancy remained criminally responsible.
