Prosecutors have now laid out what they describe as a “mountain of evidence” against Tyler Robinson in the Charlie Kirk case: video evidence, DNA allegedly found across the rifle, alleged admissions to his boyfriend and friends, the recovered weapon, ammunition, and evidence the state says establishes motive, means, and opportunity. But at this stage, one of the biggest legal fights isn't simply whether the state can establish probable cause that Robinson was the shooter. It's whether prosecutors have the aggravating circumstance necessary to pursue aggravated murder and potentially the death penalty.
I break down the state's arguments and separate the theories I believe are weak from the one that may actually matter. I'm not persuaded that political disagreement with Charlie Kirk, standing alone, provides the relevant capital aggravator, and I don't think the presence of children is the state's strongest route either. The serious argument is much simpler: prosecutors say firing a high-powered rifle from roughly 400 feet into an event surrounded by thousands of people knowingly created a great risk of death to people other than Charlie Kirk. At a preliminary hearing, where the standard is probable cause and the evidence is viewed favorably to the state, I believe that argument has real legal force.
This is where the Charlie Kirk prosecution moves beyond the question of who allegedly fired the shot and into the fight over what punishment the law could ultimately permit.
