Richert v. Handly

By default, partners in a general partnership share profits and losses equally.
But in Richert versus Handley, Washington's highest court considered whether this default rule changes based on each partner's contributions to the partnership.
Theodore Richert and C.C. Handley were partners in a logging partnership.
The men agreed to share the company's profits equally, but they didn't specify any particular method for sharing losses.
Richert made several capital contributions to the partnership, totaling approximately twenty seven thousand dollars.
Handley, on the other hand, made no capital contributions, but used his own tractor and equipment for the partnership's business.
After operating for some time, Richert filed an action for an accounting and dissolution of the partnership.
At the time, the business had approximately fifteen thousand dollars in net receipts.
However, after accounting for the return of Richert's capital contribution, the business had a twelve thousand dollar net loss. Richert argued that Handley was required to reimburse him for the difference between the balance due on his capital contribution and half of the net loss. The trial court disagreed and held that neither Richert nor Handley was entitled to judgment against the other. Accordingly, the trial court dismissed Richard's complaint.
Richert appealed to the Washington Supreme Court.
