National Treasury's new draft Public Procurement Regulations, published April 2026, set aside all state contracts under R20 million exclusively for businesses that are 100% owned by previously disadvantaged persons. According to NEASA's Gerhard Papenfus, that means "white male-owned businesses, even PARTLY white male-owned businesses, are completely excluded", despite South African courts previously ruling government cannot disqualify tenders purely on race.
