Bodycam Footage of Woman Being Arrested For BUI While operating a Jet Boat.
On 3/31/2024, at approximately 1620 hours, two sworn law enforcement officers with the Florida Fish and Wildlife Conservation Commission were on marked vessel patrol in Destin Harbor, Destin, Florida, in Okaloosa County. They observed a white mini jet boat being operated by an individual who was violating the idle speed zone. The officers conducted a safety stop and observed signs of impairment from the operator.
The weather was clear and sunny, with little to no wind and moderate vessel traffic. The officers observed the white mini jet boat passing approximately 20 yards from the bow of their vessel, continuing to violate the idle speed zone. They activated the air horn in an attempt to slow the vessel down, but the operator appeared not to hear it. The officers maneuvered their vessel behind the mini jet boat, activated the emergency lights, and initiated the emergency siren to stop the vessel. After multiple attempts, the operator finally turned to look in their direction but continued to operate the vessel through the harbor, driving towards the docks and then back out towards the channel.
Once the officers secured the vessels together, they explained the reason for the stop and noted that the operator was violating the idle speed zone by operating the vessel too fast. The operator exhibited slow, slurred speech and had glassy eyes. An empty alcoholic container (beer can) and a plastic cup with an unknown mixed drink were found in the drink holder.
When asked where they were coming from, the operator stated that they had just bought the boat in Georgia. The operator was unable to retrieve a bill of sale due to a dead phone battery. The officers maneuvered the vessels out of the channel and grounded them on the beach for safety. They asked the operator to retrieve life jackets for everyone on board, and after some difficulty, the operator found three life jackets.
The officers then requested a fire extinguisher, but the operator stated they didn't think one was needed and couldn't find one on the vessel. The operator also struggled to comprehend instructions and was unable to locate a noise-producing device such as a horn or whistle on board.
The operator mentioned owning a charter boat and having a captain's license, stating that they needed to keep the vessel going fast to prevent the front from going under the water. The officers detected a strong odor of alcohol coming from the vessel, but the operator claimed they had spilled vodka on the boat and hadn't consumed any alcohol. When asked to perform sobriety tasks, the operator admitted to possibly having consumed alcohol earlier.
The operator exhibited several signs of impairment during the field sobriety tasks, including difficulty following instructions and maintaining balance. After observing these signs, the officers placed the operator under arrest for boating under the influence (BUI).
After the arrest, the vessel was released to a sober operator, and the officers transported the individual across the Bay to postal point, where they secured the vessel. From there, they transported the individual to the Okaloosa County Jail South Annex. During the transport, the operator made various statements, including expressions of distress, confusion, and anger.
At the Okaloosa County Sheriff's Office, the officers read the implied consent to the individual, who then refused to provide a breath sample. Despite multiple opportunities, the operator declined to comply with the breath test, resulting in additional charges for refusal. The officers explained the penalties associated with refusal and operating a vessel. The individual was then placed in the custody of the Sheriff's Office.
