Morehead v. New York ex rel. Tipaldo

With a federal minimum wage law and numerous state minimum wage laws on the books, it may be surprising to think that once upon a time, such laws were considered unconstitutional.
But in Morehead versus New York ex Ralph Tipaldo, the Supreme Court struck down a New York statute for just that reason.
Joseph Tipaldo managed a laundry in New York City. Tipaldo was indicted for violating a state law setting a mandatory minimum wage for women employees.
While in jail awaiting trial, Tipaldo filed a petition for a writ of habeas corpus against prison warden Frederick Moorhead in New York state court, seeking to be released on the grounds that the statute violated the fourteenth amendment's due process clause. The trial court dismissed Tipaldo's petition. The New York Court of Appeals reversed and ordered that Tipaldo be released. The United States Supreme Court granted New York's petition for cert.
