In the case of United States v. Dirk Banks in the Central District of California, defendant Dirk Banks, through his attorneys, filed a reply supporting his application for reconsideration of a detention order issued on December 12, 2024. The court had ordered Banks detained based on perceived danger and flight risk. The initial detention relied on allegations in the first superseding indictment, including claims that Banks’ song lyrics glorified a murder and that he directed others to pay a bounty for a killing.
On May 1, 2025, the government filed a second superseding indictment, removing these two key allegations, which Banks argued were false or misleading. This change, prompted by Banks’ motion to dismiss and reconsideration application, significantly weakened the evidence against him. The new indictment lacks specific allegations of Banks’ control over others or direct involvement in the alleged crimes, relying instead on ambiguous evidence like a single text message. Despite adding a stalking charge, no new allegations were introduced.
