Despite the wet and windy weather, this driver felt that because I wasn't fully in the cycle lane, that he would disregard my safety, and pass two-feet away from me.
It's certainly well within the distance shown in rule 163 of the highway code

Given the drivers excuse, this could be classed as a punishment pass.
This is an unacceptable standard of driving, and actually falls under the definition of Dangerous Driving, as the below CPS website explains;
"• failing to have a proper and safe regard for vulnerable road users such as cyclists, motorcyclists, horse riders, the elderly and pedestrians or when in the vicinity of a pedestrian crossing, hospital, school or residential home;"

Just had a phone call from the police
They won't be taking action because they say it falls beneath the threshold for prosecution.
I was also told that I contributed to the incident by not being fully in the cycle lane, and that I move more out of the cycle lane and didn't do a shoulder check, as the bus is about to pass.... and the driver gave me room.
Note that any deviation from my course at that point, is around 6-inches.... and still puts the driver so close that I could reach out and touch his vehicle.
So it's my fault fault for not being fully in the cycle lane, my fault for having a 6-inch deviation in course.
The driver got a "be careful of cyclists mate" advice from the police.
The sergeant that called me said that if I have any other incidents, they will look at them.
