In the case of State v Strickland (me), Multnomah county deputy district attorney Kate Molina argued that a gang of thugs shouting "GET THE FUCK OUT OF HERE" while engaging in assaultive behavior toward a news videographer in an effort to prevent the news videographer from being in a public area isn't unlawful, but rather peacefully asking someone to leave. It's the journalist who's guilty of crimes if they interpret such actions to be hostile and threatening, and acts in self defense.
But in the case of State v Danialle James, Molina made the exact opposite argument, saying that it was unlawful for Danialle James to use force against KATU cameraman Carter Maynard at a protest, that such acts meet the statutory definition of Assault and Harassment. Molina claimed that Maynard had every right to be there, he was just doing his job.
If the latter were the case, then one would be justified in defending themselves against the unlawful force. But that's now the case law precedents currently stand.
