Just last week in Houston, 11-year-old Julian Guzman and his cousin were banging on neighbors’ doors and fleeing before they were answered. When they came to the residence of Gonzalo Leon Jr., Gonzalo stated that the two banged on his door multiple times. Believing they were trying to break in, he exited his home and fired at Julian with a handgun, ultimately killing him.
If only they had a Byrna… Gonzalo could have used an SD, CL, or even the larger TCR platform to engage the pair with less-lethal force if he thought they might be on his property for nefarious reasons. While Texas, like many states, has strong “stand your ground” and castle doctrine laws, homeowners may only use deadly force when it is immediately necessary to prevent assault, robbery, or other crimes after someone unlawfully enters their property.
The homeowner in this case has been arrested for murder, with bond set at $1 million. Prosecutors have stated they will be seeking the death penalty.
