GREEN CARD PROCESS | L1A TO EB1C | MOVE TO AMERICA
Selina gives an update on our protracted green card process. We are transitioning from an L1A visa to EB1C.
So where are we with our green card?! It has been a while but that is because it has taken a while to get everything together. A mixture of me, finding time plus the attorneys putting it together.
• In the last video I explained I was preparing for the information for the attorney to compile the petition for the i-140 form.
• For an l1a visa holder the i-140 is the first step to apply.
o For this I compiled together a very detailed report of my US role, my team, their education, their duties.
o In addition to my previous role in the UK.
o I shared org charts. Emails.
o And also needed to obtain a letter signed by my previous manager, from the UK office.
• That was filed on Dec 1st. And we have a receipt number where we can track the visa progress
o We expect the approval to take anywhere from 10 -12 months.
• Now – as I am already in the USA we can do something called a concurrent filling. Where you file for i-485 form at the same time. Attorneys should only recommend this if they believe the GC will be approved.
o This is where we file for the AOS at the same time. We decided to file the petition first, to save time. Some wait for i-140 to be approved then apply for AOS. Making the process longer.
o Since then I have been putting the information together for the AOS for both myself and Ant. This is more information based on where I was born, addresses, employment, places travel etc. – so not about the role. As this is in the petition. This is background information.
o Completed that information 2 weeks ago.
o With that AOS we are also applying for the work permit, and travel authorisation.
o As the final part of the AOS application, we are also completing medicals.
o The medical requires …. Making sure you are up to date on vaccines,
We had to get a flu shot
Had to have 2 lots of blood taken.
o We will complete this tomorrow.
o 6 photos each.
o Then submit to attorney for filing.
• Then that is it for now.
o It is then a case of waiting for approvals. I believe the work permits and travel authorisations should come through at some point.
• The green card approval is probably going to be a year’s wait.
o We hope there isn’t an RFE or that we need to go for medicals again. This can happen if the application takes longer. Normally 2 years. Currently 4 years so we hope we are good.
