AUCTION DISCLAIMER

REQUIREMENTS TO PARTICIPATE
1. YOU MUST READ THE FULL RULES IN THE DESCRIPTION BOX.
2. You MUST be signed in to your YouTube Acct.
3. You MUST switch to "LIVE CHAT."
(HOW: Scroll to top of chatbox, click on "TOP CHAT" then click on "LIVE CHAT.") This reduces SOME lag time.
4. WINNERS MUST KNOW THEIR ITEM # AND WINNING BID AMOUNT!
WHEN & HOW TO BID
1. Auctions are 90 SECONDS (1.5 mins).
2. Due to lagging between the video/audio & the chatbox, YOU MUST PAY ATTENTION TO THE CHATBOX DURING BIDDING! Everyone lags at a different rate.
3. Gina will type "START" into the chat to indicate beginning of each Auction’s bidding.
4. Place your bid ONLY AFTER SEEING "START" in the chat.
5. Bids placed before the "START" are NOT valid.
6. Bid only in whole-dollar amounts (no cents).
7. When Auction time has ended, Gina will type the word "STOP" into the chat.
8. Bids shown in the chatbox after the "STOP" are NOT valid.
HOW WINNERS ARE DETERMINED
1. The first highest bid shown in the chatbox immediately before "STOP" wins.
2. FINAL RULING of Winners will ONLY be made by Gina BASED ON TIMESTAMPS SHOWN on the device on which the words “START” and “STOP” were typed.
3. Gina will attempt to clarify questions & discrepancies during the auction. If she’s unable to make determination during the Auction, then she’ll review the video & timestamps on 08/17/24. Gina’s findings & FINAL RULING will be sent to the appropriate parties.
SHIPPING COSTS, INSURANCE, and TIMEFRAME
1. Auction and Giveaway Winners are responsible for ALL shipping costs. Watercolors will be $10. 12x12 & 14x14 and round pieces will be $15, 16x20 will be $25 and 18x24 & 20x20 will be $35.
2. OUR APOLOGIES, BUT THERE IS NO INTERNATIONAL SHIPPING AVAILABLE FOR THIS AUCTION. Shipping can only be made within the continental US, Hawaii, & Alaska.
3. Shipping is from Baltimore, MD to Winner's requested shipping address.
4. Paintings will be shipped by FEDEX, UPS or USPS
5. SHIPPING INSURANCE is included in shipping fees.
6. Gina DeLuca is NOT RESPONSIBLE for items lost or damaged in shipping. Buyer must work with the shipping company.
7. It's anticipated that shipping will be completed within 14 days after the Auction (by Sat. 05/31/25).
8. A tracking number will be provided to the Winner.
9. AUCTION ITEMS WILL NOT BE SHIPPED UNTIL FULL PAYMENTS OF BID AND SHIPPING COSTS HAVE BEEN RECEIVED BY GINA.
WINNER'S REQUIRED INFORMATION and TIMEFRAME
1. At the end of the Auction, but no later than Tues. 5/20/25 @ 11:59pm EST, the Winner must EMAIL the following information to GinaDeLucaArt@gmail.com
A. Item number(s) that you won – PUT ITEM # IN EMAIL SUBJECT LINE
B. Your winning bid amount(s)
C. Your first and last name
D. Your YouTube name (nickname)
E. Your Email address
F. Your Phone number
G. The Email address associated with your PayPal account
H. The shipping address INCLUDING ZIP CODE
I. The amount of additional Shipping Insurance you want for each item won.
2. PLEASE HELP GINA QUICKLY GET YOUR ITEMS TO YOU BY GIVING COMPLETE AND ACCURATE INFORMATION IN YOUR EMAIL!
3. Gina needs the above information NO LATER THAN the Tues. 5/20/25 at 11:59pm. ET.
4. If YOUR REQUIRED INFORMATION is not received by Gina by Tues. 5/20/25 at 11:59pm ET at the latest, then YOUR WINNING BID WILL BE DEEMED NULL and VOID, and the ART FORFEITED and retained by Gina DeLuca.
5. Forfeited art may be offered to the next highest bidder or held for future full-price sale.
INVOICING
1. You will receive INVOICE on or before Wednesday 05/21/25 by 11:59pm ET.
PAYMENTS
1. PAYMENT IS DUE UPON RECEIPT OF EACH INVOICE.
2. PAYMENT MUST BE RECEIVED BY GINA NO LATER THAN Friday 05/23/25 at 11:59pm ET.
3. If ENTIRE PAYMENT is not in Gina’s hands by Friday 05/23/25 at 11:59pm EST, then the sale will be deemed null and void, and the art will be forfeited and retained by Gina.
4. Zelle is the preferred payment methods.
5. PayPal is also acceptable.
6. Cash & Checks are NOT accepted.
7. Forfeited art may be offered to the next highest bidder or held for future full-price sale.
