Georgia auditor visited the Lincoln County Sheriff's Office Thursday June 10th 2021 and was denied service. Deputies unlawfully detained him, unlawfully identified him, and ran his tag.
He later called the Sheriff's Office to redress his grievances, and to find out how to file complaints on all the deputies involved. The Sheriff said that videotaping is considered a RED FLAG, and explained that "information has been sent out to all the offices in Georgia and throughout the southeast about situations with people coming around videotaping". "That won't be tolerated" says the Sheriff. He went on to say that "we can ask for identification anywhere we want to", and we can threaten people with arrest if they don't cooperate. He then said "get a lawyer" and hung up the phone.

As to the First Amendment claim under Section 1983, we agree with the Smiths that they had a First Amendment right, subject to reasonable time, manner and place restrictions, to photograph or videotape police conduct. The First Amendment protects the right to gather information about what public officials do on public property, and specifically, a right to record matters of public interest.
